In order that the assets can pass into the discretionary trust already mentioned, both the husband and wife should own assets in their own right that can be left to the trust. It is normal that individuals hold assets jointly. Jointly owned assets, such as those held in joint tenancy, would normally automatically pass to the surviving spouse and so would prevent this type of planning. 

You should consider severing the joint tenancy and setting up your assets as tenants in common. 

This would mean that assets could easily be split on death to use for tax planning.
